ClearClaim Website Terms and Conditions

1. Acceptance of Terms

By accessing or using the ClearClaim website and SaaS platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). ClearClaim is a proprietary SaaS prototype operated by Base Creative Consultants Co. Ltd, a company registered in Hong Kong. If you do not agree to these Terms, you must not use the Service.

2. Prototype / Pre-Release Notice

  1. Testing Purpose: ClearClaim is a pre-release prototype offered solely for evaluation, demonstration, and testing purposes.
  2. Modifications: We reserve the right to modify, suspend, or terminate the Service (or any feature thereof) at any time without prior notice.
  3. Pending Branding & Entity: The name "ClearClaim" is a temporary trademark/brand name pending registration. The Service will be transferred to a separate legal entity upon future incorporation without requiring additional consent from users.

3. Use of Service & Intellectual Property

  1. Ownership: All intellectual property rights in the Service—including software, designs, algorithms, workflows, text, and trademarks—belong exclusively to Base Creative Consultants Co. Ltd (and its future assignees).
  2. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and test the Service for internal business evaluation.
  3. User Data: You retain ownership of any textile claims or business data you upload to the platform. By uploading data, you grant us a non-exclusive license to process that data solely to operate and improve the prototype. Do not upload highly sensitive commercial trade secrets to the prototype.

4. Disclaimer of Warranties

To the maximum extent permitted by applicable law:

  1. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
  2. We do not guarantee that the prototype will be error-free, uninterrupted, secure, or that data uploaded will not be subject to loss or corruption.

5. Limitation of Liability

Base Creative Consultants Co. Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to, use of, or inability to use the ClearClaim prototype, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the prototype is to stop using it.

6. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
